As per Section 14 of the Data Protection Act 2017 (DPA), no person shall act as controller or processor unless he or it is registered with the Commissioner. Subject to section 43(1), any person who commits an offence under this Act for which no specific penalty is provided or who otherwise contravenes this Act shall, on conviction, be liable to a fine not exceeding 200,000 rupees and to imprisonment for a term not exceeding 5 years. |
Name of company should not be identical to existing names
A registered office is required
A company shall have at least one residential director
At least one shareholder is required.
Note:
In case, the company is limited by guarantee or
limited by both shares and guarantee the name and details of
the member should be included.
A company may have one or more secretaries.
